The client (client) and Property Vids Productions LLC (PVP) agree: 

1. The Client represents and warrants it has obtained (i) the unrestricted consent of the owner or occupant of the Premises allowing the full access to the Premises by PVP staff and contractors to videotape and photograph the Premises as needed to produce the Finished Project, and (ii) the acknowledgment of the owner or occupant of the Premises that PVP shall be the exclusive owner of the Finished Product and/or the Raw Images as set forth herein.

2. The Client acknowledges that if the shoot date is cancelled within less than 24 hours then they will be subject to a $50 cancellation fee.

3. The Client agrees to have the property “photo/video ready” before the contractor arrives. The contractor will not be responsible for any moving, decorating, staging, or rearranging of furniture. Please review our “preparing for a photoshoot” document. Due to scheduling, the contractor is not obligated to wait at the property while the client prepares the home. This can be subject to a re-shoot and a $50 added fee.

4. The Client acknowledges this is not a work made for hire agreement. PVP shall be the exclusive owner of the Finished Product, copyrights and other intellectual property rights, and all of the original and edited content, videos and photographs created by PVP to produce the Finished Product (the “Raw Images”). PVP may edit the Raw Images by any means convenient to create the Finished Product. The Client acknowledges that it does not have any claim of ownership or claim of copyright, patent, or other intellectual property right to the Finished Product and/or the Raw Images.

5. PVP may (i) use the Finished Product and/or the Raw Images for any use on its website, their offices, in printed media, and for any other promotional, advertising, marketing or public relations activities or efforts by PVP without limitation or restriction.

6. The Client shall not, directly or indirectly, (i) solicit or attempt to solicit any employee or contractor of PVP to terminate their employment or contractor relationship with PVP, or (ii) hire or attempt to hire any employee or contractor of PVP, for any reason without the express written consent of PVP.

7. Unless otherwise negotiated, all of our video packages come with two drafts. Additional edits after the second draft are $75 + TAX each. Due to the nature of our business, we do not accept editorial notes over the phone. Please contact us at propertyvidsproductions@gmail.com for any edits you may require unless otherwise instructed.

8. PVP uses Google Drive to send the finalized files to you once payment is received. If you request edits within 6 months after the project has already been finalized, a reopening fee of $150 + TAX will apply for the first new draft, plus $75 + TAX each draft thereafter. If you have other requests, additional charges may apply.

9. PVP is not responsible for uploading any content to the clients social media accounts, or the MLS.

10. All sales are final. Payment is subject to the deliverables met, not the opinion of those deliverables. We do not accept “returns” or treat our images as “samples”. We will always put forth our best effort and work with the client to reach the desired outcome for everyone involved.
